RANGRA V. BROWN REHEARING | Tuesday, August 18th, 2009

The Fifth Circuit has GRANTED REHEARING in the Rangra v. Brown case.

The court recently ruled that the criminal provisions of the Texas Open Meetings Act chill the First Amendment rights of city officials, and remanded the case to the federal district court to determine if those provisions can survive constitutional strict scrutiny (which they CANNOT).
